The EPA regulates asbestos removal through regulations entitled the National Emissions Standard for Hazardous Pollutants (NESHAP).
The NESHAP regulations governing asbestos aim to protect the public by minimizing the release of asbestos fibers into the air during activities involving the handling, processing, and disposing of materials containing asbestos. For example, the NESHAP specifies work practices to be followed during demolitions and renovations of all structures, installations, and buildings, except for residential buildings that have four or fewer dwelling units. Building owners and/or contractors are required by the regulations to notify applicable state and local agencies and/or EPA regional offices before all demolitions, or before the renovation of buildings containing a certain threshold amount of asbestos.
Despite these regulations, the laws protecting the public are not always followed. State and federal agencies levy fines against building owners and contractors that violate these rules, and state and federal attorneys sometimes seek prison sentences for violators.
